BITCOIN 201: Legal Outlook for Business

 

Last Friday I attended a great Bitcoin 101 presentation hosted by Techbase10 and the guys at 212ths. Lamar Wilson of 212ths and Jim Francis of Francis Law Office provided wonderful overviews of Bitcoin from both the technical and entrepreneurial side (Lamar) and the legal side (Jim). The limited time frame, however, and the huge amount of information, necessarily kept the discussion at a very high level. In this post, I hope to expand a bit on how the law currently is applied to entrepreneurial businesses seeking to innovate with Bitcoin. As Jim made clear, the legal and regulatory landscape is still in a nascent state and very unsettled. There are, however, a few things that are starting to become more clear, which I hope to pass along here.

Trademark Tips for Picking a Name

 

I’m going to cover one of the most common problem areas I see in my trademark practice – choosing a new name for a business or product. I frequently get asked for help “trademarking” a name that someone has already chosen for a new business. Depending on the name and some other factors, securing solid trademark protection for an existing name is sometimes easy and sometimes not. If you follow these tips, you’ll go a long way towards making trademark protection an easy job for your lawyer, not a hard or impossible one.
